Subject: 10406/96-051 Martin Date: Mon, 27 Feb 1989 12:20:00 -0500 1996-051 Dr. & Mrs. Walter Martin, Jr. ORDINANCE NO. 10406 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 1301 SOUTH JOINER ROAD, BEING ON THE NORTHWEST LINE OF SOUTH JOINER ROAD SOUTHWEST OF EAST BRAINERD ROAD, FROM R-1 RESIDENTIAL ZONE TO R-3 RESIDENTIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 1301 South Joiner Road, being on the northwest line of South Joiner Road southwest of East Brainerd Road. Two unplatted tracts, being the properties described in deed book 3016, page 514, ROHC. Tax Map No. 158L-F-1 and 7. from R-1 Residential Zone to R-3 Residential Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Screening and landscaping as shown on site plan; 2. Density as shown on site plan; 3. Approval of access by City Traffic Engineer; 4. Design review by Design Center; and 5. Donation of 30 feet right-of-way from centerline of Gunbarrel Road for the full length of the property. 6. Donation of 25 feet right-of-way from centerline of Joiner Road for the full length of the property. 7. Install curb and gutter and sidewalk the full length of the property along Gunbarrel Road. 8. Install a left-turn lane with two 100-foot tapers and with a 150-foot stacking lane on Gunbarrel Road at the complex's main entrance. 9. Install curb and gutter the full length of the property along Joiner Road. 10. Install a right-turn deceleration lane with a 75-foot taper and with a 75-foot stacking lane on Joiner Road at the complex's entrance. 11. The owner shall submit drainage plans and calculations to the Stormwater Manager so as to design the rate of stormwater run-off the property after development to be no greater than the rate of stormwater run-off the property under existing conditions for a 25-year storm design and to further design not to have any negative impact on the 100-year storm. 12. The existing small wetlands on the property shall stay in place. 13. To improve the quality of stormwater leaving the site, the owner shall install oil skimmers whose quantity and location is approved by the Stormwater Manager. 14. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as required by law.
